To all people to whom these presents shall come, Greeting Know ye
that I Owen MackDaniel of Bertie Precinct in the County of Albemarle
within his Majesty's Province of North Carolina, for and in consideration
of
the sum of twenty five pounds cash Virginia currency in hand before
the
ensealing hereof well and truly paid by EDWARD TOOL of the Precinct
and county aforesaid or secured to be paid, the receipt whereof I
do
hereby acknowledge and myself therewith fully satisfied contented and
paid and thereof and of every part and parcel thereof, do exonerate

acquit and discharge the said EDWARD TOOL, his heirs executors,
administrators forever by these presents, have given, granted, bargained,
sold aliened, conveyed and confirmed unto him the said EDWARD TOOL,
his heirs and assigns forever, one message or tract of land and plantation
lying and being in the county and
precinct aforesaid containing by estimation two hundred acres be
the same more or less butted and bounded as followeth beginning
at a maple standing in Jumping Runn at or nigh the water course;
thence running along a row of marked trees to a Red Oak standing
in Branch of Flagg Run; thence along the said Branch to scrub
White Oak; thence along a row of marked trees till comes to Thos
Busbey's corner tree; then along Busbey's line until it meets
with Jumping Runn, so down Jumping Runn along the main water-
course of the said Run until it comes to the first station being
part of a
patent formerly granted to John Naini bearing date of 5th of April 1720

and made over by conveyance by John Naini to Owen MackDaniel in the
year of our Lord one thousand seven hundred twenty five and now
conveyed by Owen MackDaniel unto EDWARD TOOL as aforesaid. To
have and to hold the said granted and bargained premises with all
the
appurtenances privileges commodities to the same belonging or in any
wise appertaining to him the said EDWARD TOOL, his heirs and assigns
forever to his and their only proper use, benefit and behalf forever
and
the said Owen MackDaniel for me and my heirs and administrators do
covenant promise and grant, to and with the said EDWARD TOOL, his
heirs and assigns before the ensealing hereof, I am the true sole and

lawful owner of the above bargained premises and lawfully seized and
possessed of the same in mine own proper right as a good perfect and
absolute state of inheritance in fee simple and have in myself good
right
full power and lawful authority to grant, bargain sell convey and
confirm
the said bargained premises in manner as above said & that the said
EDWARD TOOL, his heirs and assigns shall and may from time and at all
times forever, hereafter by force and virtue of these presents lawfully
peaceably and quietly, have hold use occupy, possess and enjoy the said
demised and bargained premises with the appurtenances free and clear,

freely and clearly acquitted, exonerated and discharged of from all and
all
manner of former or other gifts, grants bargains sales leases mortgages
wills
entails Jointers dowers judgments executions encumbrances and extents
furthermore I the said Owen MackDaniel for myself my heir executors and
admrs do covenant and engage the above demised premises to him, the said

EDWD TOOL his heirs and assigns against the lawful claims or demands
of any person whatsoever for ever, hereafter to warrant, secure and defend
in
witness whereof I have hereunto set my hand and fixed my seal this 1st
day of August 1736. Owen (his) M (mark) MackDaniel & a SEAL signed,
sealed and delivered in the presence of John Harrell, John Harrell,
Junr,
George House Bertie Precinct November Court 1736 The within deed of sale
was acknowledged in open court in due form of law, which on motion is
ordered to be registered.
